THIS STATEMENT IS SUBMITTED TO REPORT A DISTRIBUTION OF CASH DURING THE YEAR WHICH RESULTED IN A SUBSTANTIAL CONTRACTION OF ASSETS. THE FOLLOWING INFORMATION IS SUBMITTED IN ACCORDANCE WITH TREASURY REGULATION SECTION 1.6043-3(A)(1) AND THE FORM 990-PF INSTRUCTIONS: DURING THE TAXABLE YEAR ENDING JUNE 30, 2023, THE FOUNDATION MADE A DISTRIBUTION OF ASSETS FROM SOURCES OTHER THAN CURRENT INCOME. THE DISTRIBUTION, WHICH WAS A GRANT REFUND OF $13,045,566 (SEE PART I, LINE 23, COLUMN A), MADE PURSUANT TO A SETTLEMENT OF LITIGATION, REPRESENTS 25% OR MORE OF THE FOUNDATION'S NET ASSETS OF $20,289,210 (AS MEASURED BY FAIR MARKET VALUE) AT THE BEGINNING OF THE FOUNDATION'S TAXABLE YEAR ENDING JUNE 30, 2023. ALTHOUGH THE FOUNDATION TECHNICALLY EXPERIENCED A SUBSTANTIAL CONTRACTION, IT WILL CONTINUE IN EXISTENCE AND HAS NO PLANS FOR DISSOLUTION.
