About

This is a small private foundation operated by volunteers. The trustee did demonstrate ordinary business care and prudence in meeting the tax filing requirements. An extension was timely filed. When it came time to file the return the foundation enlisted our services and provide the 1099 tax documents and year-end bank and brokerage statements. On October 31st, 2018 our office contacted the client and informed them that that we needed each monthly statement for the brokerage and bank account. This information was downloaded directly from the clients' brokerage account and emailed to our office. For some reason the PDF files that we received from the broker were blank. Because the client is on the west coast and our firm is on the east coast we thought it would be faster to resolve the technical issues vs. having them mailed. Unfortunately It took much longer then expected to resolve this issue resulting in the delay in filing the return. I think that the foundation has proven reasonable cause and is requesting abatement of the late filing penalty.
