IN ACCORDANCE WITH THE TRUST'S GOVERNING DOCUMENTS, BETWEEN 90% AND 100% OF THE NET INCOME IS DISTRIBUTED NO LESS OFTEN THAN ANNUALLY TO 3 PUBLIC CHARITIES IDENTIFIED IN THE TRUST'S GOVERNING DOCUMENTS. THE AMOUNT PAID TO THE DESIGNATED CHARITIES IS DEPENDENT PER THE GOVERNING DOCUMENTS ON A DETERMINIATION OF NET INCOME; THEREFORE, THERE WILL ALWAYS BE A TIMING DIFFERENCE BETWEEN THE TIME THE INCOME IS EARNED AND WHEN IT IS PAID OUT. THE TRUSTEES HAVE WORKED WITH THE CHARITIES TO ESTABLISH GUIDLELINES AND PROCEDURES FOR PAYING THE REQUIRED AMOUNTS IN A TIMELY AND EFFICIENT MANNER. THE DESIGNATED CHARITIES RECEIVE THE FOLLOWING AS SOON AS PRACTICAL AFTER THE BOOKS FOR THE PRECEDING YEAR ARE CLOSED: A CHECK FOR THEIR SHARE OF THE NET INCOME, A COPY OF THE FINANCIAL STATEMENTS, AND A COPY OF THE TRUST'S TAX RETURN.THEREFORE, IN ACCORDANCE WITH IRC 4942(G)(2)(B) ALL PAYMENTS SUBJECT TO SET-ASIDES ARE PAID WITHIN 5 YEARS (IN PRACTICE, WITHIN 1 YEAR). THE PROJECT HAS BEEN DEFINED AS THE DETERMINATION OF THE PRIOR YEAR NET INCOME.
