BELLA KIND FOUNDATION A NJ NONPROFIT CORPORATION

Explanation for Amended 2024 Return and Reasonable Cause Statement To Whom It May Concern, I am writing to provide an explanation regarding the Bella Kind Foundation?s amended 2024 return and to respectfully request consideration for reasonable cause. Following the filing issue with our 2023 return, I subsequently filed the 2024 Form 990-EZ through TaxZeroNE.com, an IRS-approved e-filing system. This return had been prepared prior to my realization that our organization is classified as a Section 501(c)(3) private foundation, which requires filing Form 990-PF rather than Form 990-EZ. I submitted the 2024 Form 990-EZ in good faith to ensure there was a record demonstrating the Foundation?s continued intent to comply with IRS filing requirements and deadlines. Once I became aware of the initial classification and form error from the prior year, I took immediate steps to correct it. I am now submitting the amended 2024 Form 990-PF with the correct filing period and complete information. Moving forward, all future filings beginning with the 2025 tax year and beyond will be submitted using the proper form type and corresponding filing dates. Additionally, I would like to formally request consideration for reclassification of the Bella Kind Foundation as a public charity, as our programs and operations are consistent with organizations that qualify under that designation. The Foundation?s mission is to empower and support youth through community-based programs, scholarships, and initiatives that directly serve the public. Our funding model and outreach efforts rely heavily on community engagement and public support, which align with the characteristics of a publicly supported organization. The original filing errors were made in good faith, based on a misunderstanding of the correct filing requirements, and not due to willful neglect. Once identified, corrective action was taken promptly to ensure full compliance. I respectfully request that any penalties related to these filings be waived for reasonable cause. Thank you for your time, understanding, and consideration of our request. Please let me know if any additional documentation or clarification is needed to support this submission. Sincerely, Laura Giacobbe Founder, Bella Kind Foundation
