The Foundation's administrator initially mailed a request to update the Foundation's name in the Internal Revenue Service's (the "Service") database in advance of any tax deadlines. Due to the IRS' backlog and through no fault of the Foundation, to date the name change request has still not been processed and the Foundation has been prevented from enrolling in EFTPS to make any tax payments. The funds have been disbursed from the Foundation's account and are being held by the administrator until such time that EFTPS enrollment can be completed successfully. As such, Form 2220, if applicable, was prepared as if the name change had been acknowledged and reports the quarterly estimated tax payments as made timely by the original due dates of such payments. In addition, Form 990-PF Part V, Line 6a, Line 6c, and/or Line 9 includes payments as applicable. Once the name has been updated on the account by the Service, the Foundation's administrator will enroll the Foundation in EFTPS and submit all required payments on its behalf. According to the standards set forth in Rev. Proc. 92-85, we believe the Foundation's actions were reasonable and in good faith. We respectfully request that no underpayment penalties of quarterly estimated taxes and/or late payment penalties be assessed in connection with such payments.
